West Allis man not guilty in open carry gun case

A West Allis municipal judge today ruled in favor of a local man arrested for disorderly conduct after a neighbor complained that he was carrying a gun while planting a tree.

Judge Paul Murphy found Brad Krause not guilty of disorderly conduct in a case that drew to a hearing numerous gun rights advocates to witness what may be the first open carry gun case heard in a Wisconsin courtroom.

For Krause, however, the significance of the case extended beyond gun rights: It was an infringement on civil liberties, he said after today's decision.

"The reason people are upset about this is it's not about guns. It's about civil liberties. And we obviously have a property issue. There was no warrant issued, no exigent circumstances, no permission to enter the property, yet the police stormed in with guns drawn and put my life at risk," Krause said. "My wife was very worried that she would be a widow in short order because I was planting a tree."

West Allis Police Chief Mike Jungbluth could not be reached for comment on Wednesday afternoon.

West Allis Assistant City Attorney Jenna Merten, who prosecuted the case, was in trial throughout Wednesday and was unavailable for comment. City Attorney Scott Post declined to comment because he had not yet learned the basis for the judge's decision, he said.

West Allis police responded to Krause's home last August after a neighbor called to ask about the legality of him openly carrying a gun in a holster on his property. Police responded, arrested Krause and ticketed him for disorderly conduct, an offense he and his attorney, Steven Cain, fought during a court trial in December. Police also seized his gun.

Cain said today, "The big overarching issue is whether open carry is legal. The law in Wisconsin really only limits concealed carry. The law in Wisconsin, as we see it, is that open carry is absolutely legal, protected, and should be."

Cain argued that the U.S. Supreme Court last summer in the case of D.C. vs. Heller concluded that open carry is "an individual right that shouldn't be abridged by law enforcement. That's what the case is generally all about."

In explaining why he was carrying a gun while planting a tree, Krause said, "There's no requirement to justify why you're able to exercise constitutional rights. I and everyone else are able to go to church, they're able to vote, they're able to speak their mind. Even though the city might not like it, we have that right."

The case is also one that has been watched closely around the country, particularly by the co-founders of the Virginia-based OpenCarry.org, John Pierce and Mike Stollenwerk.

Said Pierce: "Really, the larger issue is not even a gun rights issue. It's the issue of having a disorderly conduct statute that is a catchall statute for otherwise legal behavior.

To All Sportsman Clubs:

This is a plea that all too often falls on deaf ears, tuned out ears, etc. The number of clubs that are prone to think that someone else is responsible for funding the organizations that back our right to own and use firearms in the pursuit of our hunting, plinking, target shooting, concealed carry rights and so forth. Well, I know better! The anti-gun factions are well organized and fully funded. We as Second Amendment supporters must do our part personally and in conjunction with our clubs find the funds that are necessary to combat the anti-gun advocates who want to take away and destroy our rights as sportsmen and gun owners. Just one cogent thought about all of you and your sportsman’s clubs: If you can’t own guns there will be no need for your clubs! Please rethink this scenario where someone else will fund our fight to preserve our Second Amendment Rights. It is not true, you and your clubs are the someone else. Dig deep and do your part to keep our shooting sports alive and well. One more thing, this is an on-going fight. Along with your support a one time, feel good donation doesn’t do it. The anti-gun owners never stop, so we have to continue the fight with ongoing support and unfortunately, this continues to cost money. The bottom line is that you are doing it for you and your rights, no one else. Take action.

Supreme Court Declares That the Second Amendment
Guarantees an Individual Right to Keep and Bear Arms

Fairfax, VA - Leaders of the National Rifle Association (NRA) praised the Supreme Court's historic ruling overturning Washington, D.C.'s ban on handguns and on self-defense in the home, in the case of District of Columbia v. Heller.

"This is a great moment in American history. It vindicates individual Americans all over this country who have always known that this is their freedom worth protecting," declared NRA Executive Vice President Wayne LaPierre. "Our founding fathers wrote and intended the Second Amendment to be an individual right. The Supreme Court has now acknowledged it. The Second Amendment as an individual right now becomes a real permanent part of American Constitutional law."

Last year, the District of Columbia appealed a Court of Appeals ruling affirming that the Second Amendment to the Constitution guarantees an individual right to keep and bear arms, and that the District's bans on handguns, carrying firearms within the home and possession of functional firearms for self-defense violate that fundamental right.

"Anti-gun politicians can no longer deny that the Second Amendment guarantees a fundamental right," said NRA chief lobbyist Chris W. Cox. "All law-abiding Americans have a fundamental, God-given right to defend themselves in their homes. Washington, D.C. must now respect that right."

Today, the 31st Circuit Court of Milwaukee County ruled that the Concealed Carry Weapons (CCW) statute was unconstitutional as applied to a particular defendant -- in this case, a pizza delivery driver who carried a gun for self-defense on the job, after being robbed repeatedly in a high crime area. 8-21-2007: Governor Doyle Pushes a Massive Gun Control Scheme!
Doyle Seeks Massachusetts Style Gun Control for the Badger State!
In an announcement today at the Milwaukee Police Department’s District 3 headquarters, Governor Jim Doyle (D) outlined a gun control package aimed not at reducing crime, but at forcing Wisconsin’s law-abiding gun-owners to forfeit their Second Amendment rights.  Not since his 2001 effort to ban the possession of all firearms other than single-shot rifles, pistols and shotguns has Doyle waged such an assault on the basic individual freedoms of the citizens of the Badger State.

 Governor Doyle, a pawn for the anti-freedom movement, is urging the Legislature to pass legislation eliminating all private transfers at gun shows.  Not stopping there, the Governor wants to repeal preemption statutes and allow local municipalities to enact their own, more onerous firearms regulations, such as the Madison handgun ban of 1994.  Doyle is also pushing for flawed ballistic “fingerprinting” technology in the Badger State, an expensive and ineffective system supposedly intended to fight crime.  Finally, Governor Doyle is seeking to expand the number of Wisconsinites who would be prohibited from owning firearms for hunting or self-defense.

 Please contact your State Senator at (608) 266-2517 and your State Representative at (608) 266-1501 today and respectfully urge them to oppose Governor Doyle’s anti-gun measures.  Also, please contact Governor Doyle at (608) 266-1212 and let him know that his priority should be locking up criminals, not eliminating the rights of law-abiding citizens.
